Not giving the cancellation notice is itself an offence

Regulation 10 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 requires a trader, before a consumer is bound by an off-premises contract, to give the information listed in Schedule 2 and a cancellation form, on paper or another durable medium the consumer agrees to. Regulation 19 makes it an offence to enter such a contract and fail to give the cancellation information, punishable on summary conviction by a fine not exceeding level 5 on the standard scale. Regulation 7(4) disapplies that Part where the payment is not more than £42.
