Charging to collect and charging to deposit are separate rules
Two provisions sit side by side. Schedule 1 paragraph 4 of the Controlled Waste (England and Wales) Regulations 2012 sets out the household waste a council may charge to collect, including any article over 25kg, anything that will not fit the bin provided, and garden waste. Section 51(2)(c) of the Environmental Protection Act 1990 requires each place provided under section 51(1)(b) to be available for the deposit of waste free of charge by residents.
