Asbestos from a home: the contractor is the producer
Regulation 13 of the Hazardous Waste (England and Wales) Regulations 2005 applies to asbestos waste “whether or not it is domestic waste”. It says nothing in those Regulations imposes obligations on an occupier of domestic premises in relation to asbestos waste produced on those premises, and that a contractor engaged to carry out works at domestic premises which produce asbestos waste “is to be treated as the producer of the asbestos waste”, and as its consignor where no other person is engaged as consignor.
