No upper limit on the fine, and the code is evidence
The waste duty of care code of practice states that failure to comply with the duty of care is an offence with no upper limit on the court's power to fine. Section 34(10) of the Environmental Protection Act 1990 provides that the code is admissible in evidence, and that where any provision of it appears to the court to be relevant to a question arising in the proceedings, it must be taken into account in determining that question.
