The household exemption does not reach a business

Section 34(1) of the Environmental Protection Act 1990 puts the duty of care on any person who imports, produces, carries, keeps, treats or disposes of controlled waste. Section 34(2) removes that duty from an occupier of domestic property, and only for household waste produced on that property. The waste duty of care code of practice lists waste producers as including shops, offices, factories, tradespeople, schools, hospitals, prisons and charities.
