When the court, rather than a notice, authorises the sale

Section 13 of the Torts (Interference with Goods) Act 1977 lets the High Court or the county court authorise a sale where a bailee satisfies it that they are entitled to sell under section 12, or would be if the required notice had been given. The court may set terms, may allow the costs of sale and any amount due from the bailor to be deducted, and may direct the net proceeds into court to the bailor's credit. Section 12(4) adds that where the bailor did not in fact own the goods, the sale gives no title against the owner.
