Defra's guidance to councils on household waste fixed penalties, updated on 1 April 2024, carries a section headed "Household waste cleared by landlords". It says that where a landlord is arranging the clearance of premises after a tenancy has ended, the resulting waste is not considered to be household waste, nor is the landlord the occupier, and that the duty of care in section 34(1) of the Environmental Protection Act 1990 applies instead. The statutory code of practice says the same of premises cleared once vacated, giving a landlord or letting agent clearing student housing as its example.
