A convincing case stops the penalty and the prosecution

The government's guidance to councils on household waste duty of care fixed penalties, last updated on 1 April 2024, tells an authority what to do before enforcing: set out the evidence gathered, say whether prosecution may follow and why, and say whether a fixed penalty would be offered instead. Its next line is short. “If an individual makes a convincing case that they complied with their duty of care you cannot give an FPN (or prosecute).”
