Hazardous waste records: three years, and twelve months

The Hazardous Waste (England and Wales) Regulations 2005 set two different retention periods. Under regulation 49(3) a producer, holder, consignor, broker or dealer preserves the record while it holds or controls the waste, and “for 3 years after the date on which the waste is transferred to another person”. Under regulation 50(2) an undertaking that transports hazardous waste keeps its records “for at least twelve months commencing on the date of delivery of the waste to its destination”.
