Regulation 35 does not apply where the waste transferred is hazardous waste and the consignment note required by the Hazardous Waste (England and Wales) Regulations 2005 is completed and dealt with under those Regulations. The waste duty of care code of practice sets retention for a hazardous waste consignment note at three years, against two years for a transfer note.
