The fixed penalty for not producing the documents
Regulation 35(1) says it takes effect as if it were made in exercise of the power in section 34(5) of the Environmental Protection Act 1990. Section 34A of that Act sets a fixed penalty of £300, offered by the Environment Agency or a waste collection authority where it appears a person has failed to comply with a duty to furnish documents imposed under regulations made under section 34(5).
