Littering, fly-tipping and the householder duty are three different penalties

These are constantly mixed up. A littering fixed penalty under section 88 of the Environmental Protection Act 1990 is £100 in England where the authority specifies no amount, and from 1 September 2026 an authority may specify not less than £65 and not more than £750. That is a separate thing from the fly-tipping fixed penalty under section 33ZA, whose ceiling is £5,000, and from the household waste duty of care penalty under section 34ZA, whose ceiling is £600.
