The government's guidance to councils on household waste duty of care fixed penalties says that “an authorised person may still fly-tip waste so tracing fly-tipped waste to a household does not necessarily demonstrate a breach of the duty of care”, and that the individual should be given an opportunity to demonstrate the steps they took.
