The government's guidance to councils on household waste duty of care fixed penalties says that “an authorised person may still fly-tip waste so tracing fly-tipped waste to a household does not necessarily demonstrate a breach of the duty of care”, and that the individual should be given an opportunity to demonstrate the steps they took. It adds that where waste is traced to someone who cannot identify who took it, or who names a carrier that is unauthorised, “it is reasonable to believe their duty of care was not met”.
