The fly-tipping fixed penalty ceiling rose to £5,000
SI 2026/816 came into force on 1 September 2026 and applies in relation to England. Regulation 3(2) amends section 33ZA(9)(a) of the Environmental Protection Act 1990, substituting £5,000 for £1,000 as the upper limit of a fixed penalty an English waste collection authority may specify for a waste deposit offence. The lower limit stays at £150, and where an authority specifies no amount the penalty is £200.
